The New Remedies Directive took effect on the 20
December 2009. One of the key changes in the legislation is the new remedy of “ineffectiveness” which gives the courts the powers to overturn a contract. Other remedies include financial penalties (fines) and contract shortening. There is also a requirement now for buyers to release the reasons for the award decision, including the characteristics and relative advantages of the winning tender, to unsuccessful suppliers at the beginning of the standstill period. Where a challenge is brought, this results in the automatic suspension of the contract award. ("The New Remedies Directive” is enacted into UK law by the Public Contracts (Amendment) Regulations 2009; the Utilities Contracts (Amendment) Regulations 2009 and the Public Contracts and Utilities Contracts (Scotland) Amendment Regulations 2009.)
