The New Remedies Directive took effect on the 20 December 2009.
Are you aware of the changes?
Suppliers shall find it easier to challenge the award of contracts under the new regulations which are now in force for procurements which commenced on or after the 20th December 2009.

One of the key changes in the legislation is the new remedy of “ineffectiveness” which gives the courts the powers to overturn a contract. Other remedies include financial penalties (fines) and contract shortening. There is also a requirement now for buyers to release the reasons for the award decision, including the characteristics and relative advantages of the winning tender, to  unsuccessful suppliers at the beginning of the standstill period.  Where a challenge is brought, this results in the automatic suspension of the contract award.

("The New Remedies Directive” is enacted into UK law by the Public Contracts (Amendment) Regulations 2009; the Utilities Contracts (Amendment) Regulations 2009 and the Public Contracts and Utilities Contracts (Scotland) Amendment Regulations 2009.)   Click here to download a Briefing Note

Mandatory Exclusion of Economic Operators
Utilities are required not to select an economic operator where they have “actual knowledge” that an economic operator has been convicted of a relevant offence under the Utilities Contracts Regulations 2006

Carbon Reduction Commitment (CRC)

Does it apply to me?
CRC is applicable to all organisations that, during calendar year 2008, had at least one half-hourly electricity meter (HHM) settled on the half-hourly market, and consumed at least 6,000 MWh of electricity through all of its HHMs.
Do you qualify for CRC?
Is your company prepared? This is a statutory requirement - any organisation that does not comply will be subject to financial penalties.
